Gary Henricks of Mastic was charged with drunken driving after a crash in July. The accident killed his grandfather, Isaac Beal, injured two passengers and caused injuries to Henricks.
Suffolk County police stated Henricks was driving on Sunrise Highway in East Patchogue and rear-ended a truck. The vehicle overturned many times and landed on the right shoulder upright. Beal was ejected from the vehicle and pronounced dead at the scene according to the article, “LI man charged with DWI in fatal crash” published by the Wall Street Journal (7.23.13).
Injuries to passenger, Donald Fowler were serious and he was listed in critical condition. Another passenger suffered minor injuries and Henricks also suffered minor injuries. Neither the driver nor the passenger of the pickup were injured.
Henricks was charged with aggravated unlicensed operation of a motor vehicle and driving while intoxicated. “With any accident causing a death, it’s obvious the driver has to face the penalties,” said Houston criminal defense attorney, Dane Johnson. “However, there was no mention of a breath test, which police would have conducted if they believed the driver had been drinking.”
Johnson stated that a sober driver could have easily rear ended the pickup and overturned the vehicle.
“Since drunk driving is one of the leading causes of car accidents, it’s often an assumption that the driver was drunk whenever an accident happens,” said Johnson. “We really don’t know what happened until we review all the details of the case.”
“Even if Henricks isn’t punished for drinking and driving, he will still face the charge of aggravated unlicensed operation of a motor vehicle.”
